HOTEL ACCOMMODATION CONTRACT

 

  • OBJECT
    Under this contract, TRANS ANDINA DEL PERU S.R.LTDA., the owner of CLUB HOTEL*** Centro de Convenciones Cusco (hereinafter referred to as the HOTEL), agrees to provide accommodation to the GUEST in the assigned room and hotel facilities in exchange for a price, based on the number of days indicated in the Hotel Registration Card. The maximum accommodation period will not exceed 30 consecutive days.
    1.1. The assigned room will be specified in the Hotel Registration Card. The HOTEL may change the room if the GUEST agrees, provided the new room is of equal or better quality, or due to force majeure or unforeseen circumstances.
    1.2. Check-in is from 12:00 p.m. on the day of arrival, and check-out is until 10:00 a.m. on the day of departure. The period between these times is considered one hotel day. Early check-in or late check-out will be subject to availability, and the GUEST will be required to pay the corresponding fee.
    1.3. Accommodation will be provided regardless of the actual length of stay. Partial use of the room still requires full payment.
    1.4. The provision of services under this contract, as well as any additional services offered by the hotel, will be subject to availability and the schedules, shifts, or availability of supplies and facilities.
  • PRICE
    2.1. The price corresponds to the per-night rate the GUEST agrees to pay, as specified in the Hotel Registration Card and the booking made. The price will be detailed in the corresponding invoice unless the booking was made through a travel agency, in which case the rate agreed directly with the agency applies.
    2.2. The GUEST must also pay for any additional charges such as food, beverages, laundry, and any other services consumed during the stay.
    2.3. The GUEST confirms they have been informed about the per-night room rates.
    2.4. Failure to pay will result in late payment interest charges at the maximum rate allowed by law.
  • CUSTODY OF MONEY AND VALUABLES
    Under the Civil Code of Peru, GUESTS may deliver money and valuables for safekeeping to the HOTEL, with a receipt. The delivery must be made in the presence of the designated hotel staff, and an inventory will be created. The HOTEL’s liability will be as a custodian under Articles 1718 and 1721 of the Civil Code. Personal valuable items left in the room or in areas not designated for safekeeping are at the sole risk of the GUEST.
  • OBLIGATIONS
    4.1. Of the HOTEL
    4.1.1. To provide the agreed services.
    4.1.2. To address and resolve any suggestions, complaints, or claims by the GUEST.
    4.1.3. To safeguard money and valuables entrusted to it, in accordance with the Civil Code.
    4.1.4. To comply with all other legal obligations.
    4.2. Of the GUEST
    4.2.1. To identify themselves with a valid ID upon check-in.
    4.2.2. To pay the accommodation cost and applicable taxes.
    4.2.3. To pay for all consumption and charges made to their account.
    4.2.4. To maintain proper conduct and dress appropriately.
    4.2.5. To be responsible for their obligations and those of their companions.
    4.2.6. To register any companions or guests at reception and pay the applicable charges.
    4.2.7. To respect the room occupancy limits.
    4.2.8. To acknowledge that participation in risky activities is at the GUEST's own risk.
    4.2.9. To use the hotel’s facilities properly and be responsible for any damage.
    4.2.10. To respect the authority of the HOTEL’s Manager.
    4.2.11. To allow room inspections or access for reasonable purposes.
    4.2.12. To permit hotel staff to access the room for cleaning and maintenance.
  • TERMINATION OF CONTRACT
    The accommodation contract will terminate in the following cases:
    5.1. Upon expiration of the agreed period.
    5.2. Upon failure to meet the obligations, such as non-payment.
    5.3. If the GUEST’s behavior or clothing disrupts the hotel’s tranquility or health standards.
    5.4. Smoking in prohibited areas, causing disruption to other guests, will result in contract termination.
  • EFFECTS OF TERMINATION
    6.1. Upon termination, the HOTEL may freely dispose of the room.
    6.2. The HOTEL may enter the room, inventory the GUEST’s belongings, and store them at the GUEST’s risk.
    6.3. If the GUEST fails to pay, the HOTEL may sell their belongings to cover the debt.
  • MISCELLANEOUS
    7.1. The accommodation contract is regulated by the Civil Code (Articles 1713-1727).
    7.2. The contract is validated by the signature on the Hotel Registration Card.
    7.3. The HOTEL rejects any form of sexual exploitation and abuse, and tourism related to these activities.
    7.4. Smoking-related charges and cleaning fees will apply as outlined.
    7.5. The HOTEL rejects any form of discrimination based on gender, race, nationality, religion, or any other criteria.
  • PRIVACY NOTICE
    By signing this contract, the GUEST authorizes the HOTEL to collect and use personal data for loyalty programs, service feedback surveys, and promotional communications, in accordance with applicable privacy laws.
  • RIGHTS OF THE GUEST OVER THEIR DATA
    The GUEST has the right to access, update, rectify, or delete their personal data, as outlined in the Data Protection Law.
